If I didn’t file my tax return for last year, can I still file for bankruptcy?
Well, technically, yes you can, but the bankruptcy trustee is going to make you file your late tax return(s) right away (unless you were not required to file a tax return because you had really low income).
Under the bankruptcy code, you are required to provide the trustee with copies of your tax returns for the prior two years at least seven days before you meet with him, which is typically about one month after you file your bankruptcy petition.
So if you are in a financial emergency (e.g., wage garnishment) but have not yet filed your tax return, you can go ahead and file for bankrutpcy and fix your tax issues afterwards.
